The ATTACK painting prints

Now that the court case has been settled, prints are available of this painting.

Last year several people requested how to get a poster of the Confederate painting. It is now on Etsy and the title of the offer is “Tim Desmond designed poster” There is more information there.So, if you know someone who said that they wanted a poster of it, it is now available

The poster is on 24 pound paper and is 24 x 25 inches.

California Confederate Flag Law Settlement

It seems a long time since the painting was finished two years ago first shown at the Sorenson Studios & Gallery’s 2015 Black & White show. It was shown there for all of May 2015. For the October 2015 Big Fresno Fair Art exhibit, it was not allowed. That prompted advice from a friend to contact CIR – Center for Individual Rights.
Yesterday, May 2, the settlement and stipulation was finalized with the attorneys at California Department of Justice. Below is the KCRE 3 Sacramento Facebook posting based on the AP release about the case.
AP had requested a photo of the painting from me for their release. There may be another piece released about this.

“SACRAMENTO, Calif. (AP) —
California’s ban on displaying the Confederate flag doesn’t apply to individuals even if they are on government property, state officials said this week in settling a free speech lawsuit.

Fresno artist Timothy Desmond sued after his painting depicting the flag was barred from the 2015 Big Fresno Fair. His painting shows Confederate soldiers fighting in the 1864 siege of Atlanta, led by a soldier carrying the battle flag.

California’s 2014 law says the state cannot display or sell the Battle Flag of the Confederacy or any similar image unless it appears in a way that serves an educational or historical purpose. Fair officials used that law to ban Desmond’s painting a year later, but they let him display the painting during the 2016 fair.

The settlement signed by the state attorney general’s office on Monday says that the ban applies only to the state government and not to private individuals. Individuals are still free to carry, display or sell the flag on private or government property.

“The First Amendment is clear: the state may not ban the expression of certain points of view simply because some find them distasteful,” Center for Individual Rights President Terry Pell said in a statement Tuesday. “Freedom of speech has costs, whether in the form of hurt feelings of those who are forced to listen or the cost of police necessary to protect against the riots that sometimes result.”

The nonprofit Washington, D.C.-based center represented Desmond in the lawsuit.

California Attorney General Xavier Becerra’s office referred requests for comment to the state Department of Food and Agriculture, where the media office was not accepting messages after business hours.

Desmond himself wasn’t commenting on the lawsuit or the settlement, a spokeswoman for the center said. The center’s website describes him as a retired high school science teacher who regularly entered his paintings in local art fairs.

It says his relatives fought for the South during the Civil War, so he became interested in their lives and the battles in which they might have fought. He found that his great-grandfather’s brother may have fought in the battle for Atlanta.”

The Doc novel reboot was the main topic of this short interview on Central Valley Talk’s  live stream webcast of Authors and Artists segment on Thursday March 30.  I also gave the host, Carole, a signed copy of the Pappy Butler novel as the last time on her show I had not received my copies of the book. A brief blurb about Pappy Butler & His Zero Time Theory is retold to Carole. Black Opal Books publisher is also mentioned. This is a shot of the set up last Saturday. It was a huge success as twenty other authors and artists were setup there also. As well as always selling a few books to new readers, what was of interest and what many came to see, was the Confederate Flag painting of California lawsuit fame. It is on the back, wall over my head and left shoulder. It looks small here but is actually 4 feet x 4 feet in dimensions.

The next event – books and showing – will be at the CWRS sponsored Civil War Reenactment at Mooney Grove Park, Visalia – March 4 and 5 weekend.

Spin or Unvarnished Truth?

Flipped on the TV this morning to GMA on ABC. The big news? The new polls on President elect’s handling of the transition. It was 40% on a graph comparing a half dozen other presidential transitions. Then the percent was higher for the two other polling questions on fixing the economy and fighting terrorism, both around 60%. Where do they get these? After the election and the exit poll debacle of all three major networks, and maybe four, how can anyone believe any poll results which are announced?
Back in the 1990s, George Stephanopoulos and James Carville in more than one documentary about the Clinton campaign and era, explain how they handled a problem by explaining, “How are we going to spin this.” Perhaps that was where the inception for the new TV show “SPIN CITY” with Michael J. Fox. 1996 – 2002
Is it all a matter of degree? While I have had a smattering of college classes in mass communication, political science, some history, oh, and don’t forget statistics ……several things come to mind. I am forced to dig up my old history by Garraty about Horace Greely and the 1860s press, Yellow Journalism and turn of 1900’s century Muck raking Press. Samuel Clemens comes to mind and his Virginia City journalism days in Roughing It make one wonder about truth in the press. Wasn’t there a raved about movie in early 1940s? Citizen Kane movie was about the negative influence of a press publisher, Supposedly about William Randolph Hearst who also supposedly ruined or sidetracked the career of Orsen Welles because of the film.
Then came TV and 1950s Madison Avenue, and the power of TV in the Nixon – Kennedy debate. It wasn’t even ten years after the 1960 election that CBS was spinning the false debacle of the 1968 Tet offensive in Vietnam.
I am not believing much in polls these days, exit polls or any others. No matter how you “skew the data.”
But a question still persists. At what point is SPIN turned into a LIE?
