The ATTACK painting prints

Now that the court case has been settled, prints are available of this painting.

Last year several people requested how to get a poster of the Confederate painting. It is now on Etsy and the title of the offer is “Tim Desmond designed poster” There is more information there.So, if you know someone who said that they wanted a poster of it, it is now available

The poster is on 24 pound paper and is 24 x 25 inches.

California Confederate Flag Law Settlement

It seems a long time since the painting was finished two years ago first shown at the Sorenson Studios & Gallery’s 2015 Black & White show. It was shown there for all of May 2015. For the October 2015 Big Fresno Fair Art exhibit, it was not allowed. That prompted advice from a friend to contact CIR – Center for Individual Rights.
Yesterday, May 2, the settlement and stipulation was finalized with the attorneys at California Department of Justice. Below is the KCRE 3 Sacramento Facebook posting based on the AP release about the case.
AP had requested a photo of the painting from me for their release. There may be another piece released about this.

“SACRAMENTO, Calif. (AP) —
California’s ban on displaying the Confederate flag doesn’t apply to individuals even if they are on government property, state officials said this week in settling a free speech lawsuit.

Fresno artist Timothy Desmond sued after his painting depicting the flag was barred from the 2015 Big Fresno Fair. His painting shows Confederate soldiers fighting in the 1864 siege of Atlanta, led by a soldier carrying the battle flag.

California’s 2014 law says the state cannot display or sell the Battle Flag of the Confederacy or any similar image unless it appears in a way that serves an educational or historical purpose. Fair officials used that law to ban Desmond’s painting a year later, but they let him display the painting during the 2016 fair.

The settlement signed by the state attorney general’s office on Monday says that the ban applies only to the state government and not to private individuals. Individuals are still free to carry, display or sell the flag on private or government property.

“The First Amendment is clear: the state may not ban the expression of certain points of view simply because some find them distasteful,” Center for Individual Rights President Terry Pell said in a statement Tuesday. “Freedom of speech has costs, whether in the form of hurt feelings of those who are forced to listen or the cost of police necessary to protect against the riots that sometimes result.”

The nonprofit Washington, D.C.-based center represented Desmond in the lawsuit.

California Attorney General Xavier Becerra’s office referred requests for comment to the state Department of Food and Agriculture, where the media office was not accepting messages after business hours.

Desmond himself wasn’t commenting on the lawsuit or the settlement, a spokeswoman for the center said. The center’s website describes him as a retired high school science teacher who regularly entered his paintings in local art fairs.

It says his relatives fought for the South during the Civil War, so he became interested in their lives and the battles in which they might have fought. He found that his great-grandfather’s brother may have fought in the battle for Atlanta.”

Salty Green Beans

Salty Green Beans
Stopped everything. ..COOKIN’ UP A MESS of SALTY GREEN BEANS.
4 to 6 strips of bacon in bottom of pot or crock pot. – OR 8 to 10 Tbspns of bacon grease + add crisped fried bacon. ..
2 pounds green string beans
1 yellow onion sliced thin, all of it
Half cup water (optional )
1 tspns salt
1 tspns pepper
I cooked it on high in crock pot 5 hours. Could cook longer, can’t hurt ’em.
Salt to taste after done cooking.

Here is a poem I wrote with salty green beans in it.
The Forage

After Atlanta’s black clouds
Those of us left, and the whole corps
Were roused to march back
West, into the Alabama route.

There weren’t no railroad
In that direction; for three days
And three nights we carried
Our roll and tramped our own.

“Take water, take water,”
The First Corporal he yelled.
“No vittles for you.
‘Til we get where we’re due.”

On the third night
The thoughts filled my head
Momma’s fried chicken, salty
Green beans, and corn bread.

We drove cattle with us now
The sergeants said soon,
We would set up a camp
And have steaks and stew.

The river was high, as we crossed
Back into Tennessee
The cattle lost footing, and
Floated by, all were lost.

On the fifth night
The thoughts filled my head
Momma’s fried chicken, salty
Green beans, and corn bread.

We halted and set up camp after
First sergeant sent us foraging
With Thomas, Henry, and Jacob
And me they called Jasper.

We found a farm
And a barn had been torched
The house stood quiet
The widow smoked on the porch.

On that sixth day
The smells filled my head
The widow’s fried chicken, salty
Green beans, and corn bread.

She told us and pointed,
“The Yankees got the hogs,
My cold cellar is yonder,
By the creek and the logs.”

Near the bank a door we found
Then a buzz and a crack
Sharpshooter smoked drifted down
While Thomas fell on his back.

At a time like this
I had no thoughts in my head
Of Momma’s fried chicken, salty
Green beans, and corn bread.

We loaded and rammed
And for a cap I fumbled,
I drew down on a head
The stilled Yankee tumbled.

In the cellar we found cold
Stacks of melons, apples,
Peaches and ham, we filled sacks
For the boys, back in the camp.

As we ate onions
It will always be in my head;
Momma’s fried chicken, salty
Green beans, and corn bread.

151st Anniversary Battle of Franklin

THE ATTACK

Today this painting is presented to commemorate the November 30, 1864 Battle of Franklin, Tennessee. Buried in history are the stories of so many and their valor on the Carter farm. As this is not meant to be a lengthy history with this posting, here is a poem about it too.

Morning cold Fires
Dried wet wool
Cotton soaked dew

Smoke floated smell
Coffee weak hot
Cartridge issued
Cheered boys well

Night moves true
Rumor we’d heard
Blame went ‘round
Union got through

Art Banned in California State Venues

3rd Confederate Infantry Regiment in Cleburne’s Division in late Atlanta Campaign 1864.

On Thursday, September 24, the artist was called to pick up the painting with the explanation that under California’s state law, the local fair district cannot hang the painting to be shown. California’s fair districts are a state run entity and fall under the 2014 law AB-2444 and cannot sell or display Confederate flags and symbols.
As a consolation, the artist was told, “the painting was allowed to be judged” and, “ had it won a place or prize, those would have been awarded to the artist.”
The fair people the artist talked with were sympathetic and showed the June 2015 letter from the State of California that was mailed to all fair districts and to all vendors and concessionaires who are operating their business at California fairs. The artist asked if he was considered a vendor or concession as he was not selling the painting. The reply was no, that the fair cannot display it. He asked for a copy of the letter and was told that they would mail him a copy. He was also told that the fair people had petitioned by telephone call to the California Fairs Director in Sacramento, that the painting depicted an historical scene, and also contacted the state Attorney General. It seemed that everyone’s hands were tied by the legislation. At some point someone in Sacramento had to have decided that the historic depiction did not matter.

Existing law regulates the sale of certain merchandise, including political items and sports memorabilia.
This bill would prohibit the State of California from selling or displaying the Battle Flag of the Confederacy, or a similar image, or tangible personal property inscribed with those images, unless the image appears in a book, digital medium, or state museum that serves an educational or historical purpose.
The people of the State of California do enact as follows:

SECTION 1. Chapter 2.9 (commencing with Section 8195) is added to Division 1 of Title 2 of the Government Code, to read:
Chapter 2.9. Confederate Flag
8195. (a) The State of California may not sell or display the Battle Flag of the Confederacy, also referred to as the Stars and Bars, or any similar image, or tangible personal property, inscribed with such an image unless the image appears in a book, digital medium, or state museum that serves an educational or historical purpose.
(b) For purposes of this section, “sell” means to transfer title or possession, exchange, or barter, conditional or otherwise, in any manner or by any means whatsoever, for consideration. “Transfer possession” includes only transactions that would be found by the State Board of Equalization, for purposes of the Sales and Use Tax Law, to be in lieu of a transfer of title, exchange, or barter.

As well as the legislature not understanding the 1st Amendment of the US Constitution, notice also, that the law erroneously refers to the “Battle Flag” as the “Stars and Bars.” In the painting is the “Second National” Confederate pattern.
